No transfer of a student from the school serving the unitary attendance area in which the student’s parents or legally constituted guardians, as hereafter qualified, reside shall be permitted unless such transfer shall have first been approved by the Office of Student Records and Transfers. In the event of a denial of transfer, the person making proper application thereafter may appeal the decision of the Office of Student Records and Transfers to the Office of Appeals, the designee for the Superintendent of Schools. The Board of Education may hear an appeal from a decision of the Office of Appeals that relates to the transfer request in accordance with law.
No person, on the basis of race, color, or national origin, is excluded from participation in, may be denied the benefit of, may be treated differently from another person, or may be otherwise discriminated against with regard to transfers. The Board of Education directs the Superintendent to develop procedures to implement the student transfer guidelines and appeals process of the Board.
